Sojourn Terms of Service

Effective Date: August 28, 20261. Acceptance of TermsThese Terms of Service ("Terms") govern your access to and use of Sojourn (the "App"), provided by Trek and Sojourn ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.2. Eligibility and AccountsYou must be able to form a binding contract to use the App and must not be prohibited from using it under applicable law. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use of your account.3. User ResponsibilitiesYou agree to provide accurate information when creating your account and to keep it up to date. You are responsible for the content you enter into the App, including journal entries, photos, and other logged data.4. User ContentYou retain ownership of the content you create in the App ("User Content"), including your hike logs, journal entries, photos, gear lists, and plans. By using the App, you grant us a limited, non-exclusive license to store, process, and transmit your User Content solely as necessary to provide and maintain the App's functionality, including syncing it across your devices.You agree not to upload or store User Content that is illegal, infringes on the rights of others, or is abusive or harmful. We reserve the right to remove content or suspend accounts that violate this provision.5. Subscriptions and BillingSojourn offers optional paid subscription tiers ("Sojourn Pro") that unlock additional features, currently offered at $9.99/month or $79.99/year, with a 7-day free trial where applicable. Subscriptions are billed and managed through the Apple App Store or Google Play, and are subject to their respective terms.● Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
● You can manage or cancel your subscription through your Apple ID or Google Play account settings.
● Refunds are handled by Apple or Google in accordance with their respective refund policies; we do not directly process refunds.
● Prices are subject to change; we will provide notice as required by the applicable app store's policies before any change takes effect for existing subscribers.
6. Availability and Changes to the AppWe may modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App or any feature.7. DisclaimersSojourn provides estimates, forecasts, and calculations (including but not limited to estimated finish dates, pace, and mileage projections) based on the data you log. These are estimates only and are not guarantees of accuracy. They are not a substitute for your own judgment, trail knowledge, official trail resources, or safety planning.THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE APP, INCLUDING ANY DECISIONS MADE WHILE HIKING BASED ON INFORMATION IN THE APP.8. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, TREK AND SOJOURN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.9. TerminationWe may suspend or terminate your access to the App if we believe you have violated these Terms. You may stop using the App and delete your account at any time through Settings → Account. Upon deletion, your data will be removed as described in our Privacy Policy.10. Governing LawThese Terms are governed by the laws of the State of California, without regard to its conflict of law principles, and without prejudice to any mandatory consumer protection laws of the jurisdiction in which you reside.11. Changes to These TermsWe may update these Terms from time to time. If we make material changes, we will update the Effective Date above and, where appropriate, notify you within the App. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.12.
